Please read these Terms of Use and our Privacy Policy carefully because they form a legally binding and enforceable agreement between you and us regarding your use of our site (“Agreement”). By using our Site, you are acknowledging you have read, understand and agree to comply with and be bound by all of the terms and conditions in our agreement. if you do not or cannot agree, please do not use our site. for the avoidance of any doubt, our Privacy Policy is incorporated by this reference and forms a part of your agreement with us.
In this Agreement, “SafePoint Scientific”, “we”, “us”, “our” or “ours” refers to SafePoint Scientific, LLC, and when we refer to our “Site”, it refers to our website (URL: https://safepointscientific.com) and associated web pages. Unless the context clearly requires a different interpretation, we use terms such as “you”, “your” and “yours” generically to refer to any user, individually and/or collectively. Your use of and right to use our Site is governed by this Agreement and you should refer to our Privacy Policy to learn how we handle information we obtain when you use our Site.
In this Agreement, the term “user” refers to anyone who uses our Site and terms such as “use”, “uses” or “using” and any variations of those terms, means to any actual or attempted visit, access, submission or exchange of information, browsing, copying, image or text capture activity and/or viewing, display or taking advantage of any of the features or functions of all or any portion of our Site. When we use the term “include” or “including” it means and should be interpreted as illustrative and without limitation and not as being exclusive or limiting.
Among other things, our Site allows you to obtain information about us and contact us to inquire about our services if you are interested in becoming a customer or to submit support requests if you are an existing customer. Our Site is accessible worldwide through the Internet, but intended solely for business professionals over the age of 18 who are physically located in North America (i.e., Canada and the United States).
Privacy
We respect your privacy and take our obligations seriously. Our Privacy Policy is part of our Agreement with you and you should read it carefully since, among other things, it describes how we obtain, collect and use information we obtain through our Site, as well as your rights and obligations with regard to your information. If you are a parent or guardian and become aware that your child has accessed our Site, submitted information or we may have obtained information about your child, please notify us immediately. Once we become aware we have obtained a child’s information, we will promptly take steps to remove that information from our servers and any other places and media in our possession or under our control.
Ownership and Rights to Content
We either own, control or have a right to use all the content and material on our Site, including copyright, service and trademark rights, logos, trade names, brands, proprietary products and services and all other distinctive material, as well as the combination, look and feel and other aspects of how we organize and display items on our Site (“Content”). If there is Content on our Site that does not exclusively belong to us, we have obtained the rights to use it from the rights holder. For ease of reference, we will use the term “Site” to include all Content on or associated with or available through the use of our Site. Content is protected by intellectual property laws and international treaties, as well as rights of privacy and publicity and other laws and regulations may apply and except as noted below, you have no right to copy or use any Content unless you have obtained our express written permission in advance.

If you are interested in getting more information about how to become a customer, you can enter your contact information directly on our Site and we’ll get in touch and send you information about becoming a customer and the services we offer.
Already a Customer and Need Support?
The Site also allows our existing customers to contact us in case they need additional support. Just select the tab on our Site labeled Support and a web page will open allowing you to enter your contact information and describe the issue. That will allow us to get the right person on our team to get in touch and help you resolve it. Please understand that if you enter or submit information using our Support form and you are not an existing customer, we will have no obligation to respond and we will delete any information you sent us from our files.
Prohibited Conduct; Reporting Violations
You may not use our Site to:
- send us illegal, offensive, inappropriate messages;
- harass, cause harm or distress, disparage or annoy anyone;
- interfere with, disrupt or damage our Site or with its normal operation;
- interfere, impair or prevent anyone else from using our Site;
- compromise or endanger any person, cause or lead to damage to persons or property;
- adversely affect, infringe upon or misappropriate the rights of others; or
- interfere with or bypass any security or other protective measures applicable to our systems, networks and communications capabilities.
If, for any reason, we have reason to believe, suspect or are notified you have done, are doing or you attempt to do any act or any circumstances arise in which you are or may be in breach or violation of this Agreement, including our Terms of Use and Privacy Policy or that may violate any law or regulation that applies to you or us, you may be subject to legal action, including civil and criminal charges and we have the right, without limitation and reserving cumulatively all our other rights, to notify relevant regulatory and law enforcement authorities, provide them with information and take any other action permitted by law.

Our Site may contain content and materials of others (“Third Party Content”) and may have hypertext links to websites (URLs) of others (“Links”). We don’t monitor or review Third Party Materials or Links, nor are we responsible for their content or where any Links may redirect your browser. We also are not responsible for third party privacy practices or policies and you should make sure you review their terms, conditions and privacy practices carefully, because once you select a Link you will be leaving our Site and your information and any activity or transactions you engage in will be under the control and subject to the third party and not us. The existence of Third Party Material and/or a Link on our Site is not, does not and should not be construed as an endorsement or representation by us of any kind and we are not liable or responsible for them in any way and you use all Third Party Material and Links at your own risk.
Limit of Liability; Risk of Loss; Indemnity
Our Site is made available “AS IS” and “AS AVAILABLE” without representations or warranties of any kind, whether by operation of law, express or implied. We are not responsible to you or any third party in connection with your use of our Site, nor can we or do we guarantee your use of our Site will not be interrupted, error free, free of defects or even free from malware or malicious code. To the fullest extent permitted by law, we disclaim and are not responsible or liable to you or any other party for any loss or damage of any kind (direct, indirect, consequential or otherwise) or to any technology or mechanism you may use to access our Site, including technology you use to view, communicate, interact with or otherwise use our Site. SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OF WARRANTIES OR LIMITATIONS ON DAMAGES, SO SOME OF THESE EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.
By using our Site, you are also agreeing to fully indemnify us and hold us harmless from any claims, actions, threats and proceedings of any kind, as well as any liability, losses, damages costs and expenses we may suffer or incur, as a result of your violating the law, infringing the rights of others and/or failing to comply with any of the terms or conditions in this Agreement, as well as any actions you take, directly or indirectly, that cause harm or damage to us, our Site our systems and technology or to others.
Amendments
We reserve the right to amend this Agreement at any time and from time to time. Amendments will become effective when we post an updated Agreement on the Site. Check back frequently because if you use of our Site, it will constitute your agreement with the updated amended Agreement. If, for any reason, you do not or cannot agree to comply with everything in our Agreement with you, please leave and do not use our Site.
Governing Law
Any claim or action arising out of or relating to our Site will be construed, governed and enforced under the laws of the State of New Jersey and the Federal laws of the United States that apply. By using our Site you unconditionally and irrevocably submit to the personal jurisdiction of, agree to resolve all claims or disputes in and initiate and adjudicate all legal, regulatory or judicial proceedings in, the State or Federal courts in the State of New Jersey. You waive any right to claim the State of New Jersey is an inconvenient or improper forum and YOU ALSO HEREBY UNCONDITIONALLY AND IRREVOCABLY WAIVE YOUR RIGHT TO A JURY TRIAL.
General
This Agreement is the entire agreement you have with us regarding your use of our Site and the subject matter of this Agreement and supersedes any and all prior or inconsistent understandings, representations or agreements. If any provision of this Agreement is held illegal or unenforceable, that provision shall be severed from the Agreement without affecting any of the remaining provisions which will continue in full force and effect. Headings are only for reference and shall not affect the meaning of any term or condition. If we delay or fail to enforce any provision of this Agreement, that does not mean we waive our right to do so at any time, nor does it mean we are waiving the right to enforce any other provision or exercise any right we may have under this Agreement, at law or in equity, all of which we cumulatively reserve. Any term or condition of this Agreement that must survive to allow us to enforce its plain meaning, shall survive as long as necessary to be effective to allow and enable us to do so.
